Earlybird Affiliate Program Terms and Conditions:
1. Eligibility
Eligibility for the Earlybird Affiliate Program is geared towards individuals with a significant audience, specifically those with established websites or public social media channels suitable for product promotion. This program is not intended for those only looking to share with a small group of known contacts. Ideal candidates should have the capability to reach hundreds of unique viewers monthly. Applicants must be at least 18 years old and agree to comply with the site's general terms of use and privacy policy upon applying to become affiliates.
2. Approval
Earlybird reserves the sole discretion to accept or reject any affiliate application. Approval of an application does not automatically signify compliance with our requirements or terms and conditions. Applicants bear the responsibility of ensuring their adherence to these stipulations.
3. Commission
In the Earlybird Affiliate Program, self-referrals are prohibited. Affiliates will not earn commissions on purchases made through their own accounts. While sharing referral links with friends, colleagues, and family is allowed, it should not constitute the primary method of promotion. The emphasis should be on engaging a wider audience. Commissions are awarded based on individual referrals, with repeat purchases by the same person not eligible for additional commissions. It is important to note that affiliate commissions may vary depending on the product.
4 Payments
Your earnings from validated transactions will be processed and sent within the first 10 days of each month. We apply a general 30-day refund policy to all payouts for consistency, even if some products have different refund terms. Payments are issued via Wisel to the email you provide in your Earlybird affiliate profile, and it's your responsibility to ensure this information is correct. Payments are made only if your commissions exceed the minimum threshold of $50. Any delays in fund reception due to issues with your Wisel account are not our responsibility.
5. Responsibilities
Affiliates must promote Earlybird's products ethically and legally, avoiding fraudulent or deceptive practices. Termination of affiliate accounts may occur due to reasons like spamming, inappropriate advertising, promoting on sites with illegal or brand-damaging content, not disclosing the affiliate relationship as per FTC guidelines, violating Earlybird's trademark or advertising rules, offering unauthorized rebates or kick-backs, engaging in self-referrals or fraudulent activities. Earlybird reserves the right to terminate any affiliate account for agreement violations or other reasons.
6. Affiliate Links
As an Earlybird affiliate, you may use both graphic and text links on your website, in email communications, and across social media channels. Additionally, you have the freedom to promote Earlybird in various media, including online and offline classified ads, magazines, and newspapers. These activities must align with the terms and conditions specified in this agreement.
7. Coupons & Deal Sites
Earlybird may provide selected affiliates with exclusive coupons for their audience. Unauthorized promotion of such coupons is not allowed. Affiliates must avoid misleading links or claims about deals and refrain from bidding on terms suggesting coupon availability. They should not use tactics like pop-ups to set cookies without clear user interest. Affiliate sites must accurately represent coupon availability and not imply offers when none exist. Coupon and deal sites, as well as browser extensions, are not eligible for our program. Deal aggregators are allowed if they focus on promoting Earlybird through unique, high-quality content.
8. Liability
Earlybird is not responsible for indirect or incidental damages, such as loss of profits or commission, due to tracking issues, data loss, or any harm attempts. No guarantees are provided regarding the affiliate program or products, and Earlybird is not liable for any operational errors or interruptions of the program or website.
9. Modification of Terms
Earlybird reserves the right to modify these terms and conditions as market conditions evolve. Changes may be made at any time without prior notice and will be applied unilaterally. Significant changes will be communicated to affiliates, who are responsible for staying informed about and understanding the revised terms.
10. Indemnification
The Affiliate agrees to indemnify and hold harmless Earlybird, its related entities, and personnel from liabilities, damages, or costs due to the Affiliate’s actions related to this agreement, including negligence or misconduct.
11. Governing Law Jurisdiction and Attorney Fees
This Agreement and any disputes related to it are governed by the laws of the United Kingdom. In legal proceedings to enforce this Agreement, the prevailing party can recover costs and legal fees from the other party.
